BUYER'S
AGENT: WORKING FOR YOU!
DID YOU KNOW???
Unless the buyer specifically signs a Buyer Agency Disclosure
form, all REALTORS showing a particular property represent
the seller, either as the listing agent or as a sub-agent
(such as when you attend an open house).
Since this is the case, the listing agent and the sub-agent's
responsibilities include:
- Getting the highest possible price for the seller
- Getting the best terms for the seller
The buyer has absolutely no representation
in this situation.
These Seller's Agents cannot:
- Advise what you should offer on a property
- Offer opinions on the value of any improvements
- Offer an opinion on the condition of the property
- Inform you of any information they may have about the
seller's urgency to sell, or any other information about
the seller that could influence the sale in your favor
On the other hand, the listing or sub-agent may
report back to the seller with any information
that you reveal concerning:
- Your finances
- Your willingness to go higher on an offer you made
- How motivated you are to buy a property
To protect yourself in a real estate transaction, you will
require a "Buyer's Agent". A real estate agent
who represents only the buyer is called a "Buyer's
Agent".
In order to create an Agency Relationship, the buyer and
the REALTOR enter into an agreement by signing a contract
where the agent has exclusive rights for finding, negotiating,
and purchasing property satisfactory to the buyer.
The advantage that signing a contract has is that the agent
may put all his or her efforts into finding you the property
you are looking for, because you have a contract stating
that you must purchase a property through this agent.
I do not normally represent buyers in this
capacity. I believe if a buyer is not happy with my service, then he/she
has the right to go to someone else. This
assures that I will provide you with the best possible service.
Once we enter into this relationship, I have a fiduciary
relationship with you and, as such, I owe you the obedience,
loyalty, disclosure, confidentiality, accounting, and reasonable
care.
I commit myself to:
- Work in your best interest
- Give opinions on the value of the property
- Reveal all information about the seller including motivation and
whether the seller will take offers below the asking price
- Negotiate the best price and terms for YOU
- Present your offer personally to the seller
- I will keep you updated on all homes that meet your requirements
and maintain contact with you through all steps of the home-buying
process.
Because I work as a Buyer's Agent, I can show you any property on the
market - no matter what real estate company has it listed.
